Introduction
asymmetricstack.com respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our website.
What to Consider Before Submitting a Copyright Complaint
Before submitting a copyright complaint to us, consider whether the use could be considered fair use. Fair use states that brief excerpts of copyrighted material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without the need for permission from or payment to the copyright holder.
Please note that if you are unsure whether the material you are reporting is in fact infringing, you may wish to contact an attorney before filing a notification with us.
Reporting Copyright Infringement (DMCA Notice)
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place on asymmetricstack.com, please submit your notice in writing to our designated Copyright Agent.
Your notification must include the following information (pursuant to 17 U.S.C. § 512(c)(3)):
Identification of the Work: A description of the copyrighted work that you claim has been infringed.
Identification of the Material: A description of where the material that you claim is infringing is located on the website (please provide the exact URL).
Contact Information: Your address, telephone number, and email address.
Good Faith Statement: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
Accuracy Statement: A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
Where to Send the Notice
Please send your copyright infringement notice to the agent by email at: there4u@asymmetricstack.comÂ
Notifications of Infringement
Filing a DMCA complaint is the start of a pre-defined legal process. Your complaint will be reviewed for accuracy, validity, and completeness. If your complaint has satisfied these requirements, our response may include the removal or restriction of access to allegedly infringing material. If we remove or restrict access to materials or terminate an account in response to a Notification of alleged infringement, we will make a good faith effort to contact the affected user with information concerning the removal or restriction of access.
Notwithstanding anything to the contrary contained in any portion of this Policy, asymmetricstack.com reserves the right to take no action upon receipt of a DMCA copyright infringement notification if it fails to comply with all the requirements of the DMCA for such notifications. The process described in this Policy does not limit our ability to pursue any other remedies we may have to address suspected infringement.
Counter-Notice Procedure
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice to us.
If a counter-notice is received, we may send a copy of the counter-notice to the original complaining party informing them that we may replace the removed content or cease disabling it in 10 business days.
Modifications
We reserve the right to modify the contents of this policy or its terms related to the Website and Services at any time at our discretion. Your continued use of the Website after any such changes constitutes your acceptance of the new policy.
